The minister, 74 years old, took office this Thursday (10) as president of the Superior Labor Court (TST). In a speech, he defended the need to regulate new work modalities created with technological advances.

“The world of work has changed, it is no longer the same as it was at the beginning of the last century. Today, the largest urban transport company does not have a single vehicle. Everything is in the cloud, it’s just an algorithm,” he said.

“The provision of services in these new modalities, resulting from technological advances, requires regulation, notably regarding social security, work accident insurance and other interconnected topics”.

The app-based work phenomenon became known as “”. It is performed by delivery people or car or motorcycle drivers through mediation provided by cell phone applications.

The topic is the subject of a dispute between TST and whether or not the employment relationship of those who work in the format is recognized.

This work format does not guarantee rights such as those guaranteed by the Consolidation of Labor Laws (CLT), such as paid weekly rest, 13th salary, vacation or retirement.

According to the new president of the TST, given the gap in the law, the Judiciary must act for social pacification.
