Anatel notifies operators to unlock X

The National Telecommunications Agency (Anatel) began notifying telecommunications service providers this Wednesday morning (9). The order is for everyone to allow customers access to platform X (formerly Twitter).

“It will be up to each company to take the necessary technical measures to implement the judicial order of the Federal Supreme Court (STF). The time to carry out the unlocking will depend on the measures used by the providers, depending on their specificities”, says the agency.

Even before Anatel’s notification, some users already reported being able to access the network.

Moraes also ordered Anatel to adopt measures, within 24 hours, to comply with the decision. The minister informed that the return of activities was conditioned solely on full compliance with Brazilian legislation and “absolute compliance with the decisions of the Judiciary, in respect for national sovereignty”.

OX has been suspended in Brazil since August 30 for failing to comply with STF decisions. On Tuesday (8), the Attorney General’s Office (PGR) expressed support for the social network’s return to the country after failing to identify any reason that would prevent the company from resuming its activities.

The social network had to pay R$28.6 million in fines and comply with Alexandre de Moraes’ orders to resume operating in the country, such as suspending nine profiles on the platform and appointing a legal representative in Brazil, with due proof from public institutions.

The sum of R$28.6 million involves three types of fines. The amount is divided like this:

  • R$ 10 million (the amount represents two days in which the social network was available to users in Brazil, disregarding the suspension order);
  • R$ 18.3 million (the amount refers to fines for failing to comply with profile blocking decisions);
  • R$ 300 thousand (amount imposed as a fine on the company’s legal representative, Rachel de Oliveira, who had been punished in August, along with the platform, for non-compliance with blocking orders).
