The Federal Government established a plan to prevent and combat harassment and discrimination in the federal public administration, including agencies and foundations, after the . The initiative was published in the Official Gazette of the Union this Tuesday (1st).
The Ministry of Management and Innovation in Public Services says that the program must pay “special attention” to historically vulnerable groups, such as women, black people, indigenous people, elderly people, people with disabilities and LGBTQIA+ people. According to the ordinance, the confidentiality of whistleblowers’ personal data will be guaranteed.
Complaints must be made through the Ombudsman service channels, in person, or via the Fala.BR platform. According to the Federal Government, the statements made by the victim of harassment or discrimination will be qualified as highly relevant evidence.
The plan proposes that whistleblowers are protected against possible actions taken in retaliation, such as arbitrary dismissal, unjustified change of functions, duties or place of work, imposition of sanctions, remuneration losses and withdrawal of benefits, direct or indirect.
The initiative will be implemented through a federal network to prevent and combat harassment and discrimination, made up of members of the Federal Government and state levels. The program is valid for career and commissioned employees.
The ordinance also establishes that the composition of the disciplinary administrative process committee to investigate alleged irregularities related to discrimination must have the predominant participation of women, black, indigenous, elderly, LGBTQIA+ people or people with disabilities.
The plan defines the following specific objectives:
- Develop a set of coordinated actions to prevent harassment and discrimination, through educational strategies that address both training and awareness raising of people who carry out public activities;
- Promote humanized management in institutional spaces, whether physical or virtual, with a continuous focus on evaluating organizational culture, to ensure that prevention actions promote the desired cultural change;
- Define and structure instances aimed at promoting reception, active listening, guidance and monitoring of people affected by harassment and discrimination to mitigate the psychosocial risks of violence at work;
- Establish guidelines to promote effective actions seeking to prevent, embrace, investigate and hold accountable conflicts to build work environments free from harassment, discrimination and other types of violence.
