In addition to impeachment, the opposition talks about seizing and accessing Moraes’ phone in a document

In addition to the impeachment of Minister Alexandre de Moraes, of the Federal Supreme Court (STF), it talks about the seizure and breach of confidentiality of the magistrate’s phones, computers, tablets and other personal and functional electronic devices.

The idea appears in the impeachment request against Moraes. The document is not yet in the official Senate system, but it was shared this Tuesday (10) by the advisor of Senator Rogério Marinho (PL-RN) with the signature of the technical advisor of the General Secretariat of the Senate Board.

The text mentions the creation of a special commission of senators to then eventually determine the search and seizure of devices not only belonging to Moraes, but also assistants Airton Vieira and Marco Antônio Vargas and expert Eduardo Tagliaferro, former head of the Special Advisory on Confrontation to Disinformation from the Superior Electoral Court (TSE).

It states that, “if their secrecy is broken, they will be inspected by the appropriate technical body in order to gather evidence to support this procedure”.

A report by the newspaper Folha de S.Paulo pointed out the alleged informal use of the TSE structure under the presidency of Moraes to subsidize investigations against Bolsonaristas in the STF.

The opposition parliamentarians’ document states that it requests the issuance of letters to various bodies, entities and individuals “in view of the impossibility of complainants presenting documentary evidence, especially other decisions that prove the commission of a crime of responsibility on the part of the accused – having in view of granting secrecy to the files of investigation No. 4781/DF in progress at the Federal Supreme Court”.

The release of the document occurs approximately 24 hours after the opposition presented the text to the president of the Senate, Rodrigo Pacheco (PSD-MG), who shows no intention of moving forward with the case.

The is signed by deputies Marcel Van Hattem (Novo-RS), Bia Kicis (PL-DF) and Caroline de Toni (PL-SC), among other people and parliamentarians.

The opposition still makes other requests in this impeachment request. There is no prospect that they will progress, so far. For example:

• That the TSE present all documents produced at the request of Moraes’ assistant judges, “as well as the determinations that gave rise to such documents and reports”;
• A draft from the Attorney General’s Office (PGR) for the provisional release of Cleriston Pereira da Cunha, known as Clezão, arrested for the acts of January 8, 2023 who died in prison, in Brasília, and his medical records;
• Documents from the Army and the Ministry of Communications that prove possible impacts of any Starlink service interruption;
• Dialogues between Airton Vieira and Eduardo Tagliaferro in possession of the newspaper Folha de S.Paulo.
