The Kazakh authorities have named the condition under which a Russian resident in the country will be extradited to Russia.
Only a person who is on the international wanted list can be extradited.
Thus, a Russian’s evasion of partial mobilization is not grounds for extradition.
The head of the Ministry of Internal Affairs of Kazakhstan, Marat Akhmetzhanov, made a corresponding statement.
The essence of the agreement between Kazakhstan and Russia
Akhmetzhanov recalled the existence of a Kazakh-Russian agreement on the provision of legal assistance.
The document provides for the extradition of persons who have been put on the international wanted list.
Extradition can be carried out if one more condition is met: the act committed by the wanted person must be considered a crime in both Russia and Kazakhstan.
In addition, the extradited person must be a defendant in a criminal case.
If military registration and enlistment offices are looking for citizens of the Russian Federation, then this is not a legal basis for extradition, – quotes Marat Akhmetzhanov.
According to data from law enforcement agencies of Kazakhstan, since the announcement of partial mobilization in Russia, almost 100 thousand Russians have entered the country.
