Moraes gives X five days to complete documents proving representation in Brazil | Blogs

Minister Alexandre de Moraes, of the Federal Supreme Court (STF), determined this Saturday (21) that within five days, X (formerly Twitter) send documents to the court proving the company’s legal representative in Brazil.

Moraes further determined that within 48 hours:

  • Federal Revenue and Central Bank inform the current legal situation of X’s representation in Brazil;
  • Federal Police and the National Telecommunications Agency send reports on the continued possibility of access to platform X, through technological instruments, for the purpose of calculating any fine to be applied;
  • The Judicial Secretariat of the STF certifies the total amount of the fine owed by the representative of X and the court orders pending compliance.

OX informed the minister this Friday (20) that Rachel de Oliveira Villa Nova would represent the company’s interests in the country. .

Upon analyzing the document sent, the minister assessed that his determination had not been properly fulfilled and ordered the law firm to supplement the information proving the company’s representation.

Lawyers must present the original corporate powers of attorney granted by the partners of the platform’s controllers to the lawyer “duly notarized and consularized”.

The Brief Report Form issued by the Commercial Board of the State of São Paulo proving the appointment of the new legal representative in Brazil must also be sent to the minister within five days.

for not having a legal representative in Brazil, having failed to comply with court orders and not having paid fines imposed for non-compliance with the orders.

Compliance with the minister’s new determinations and the sending of information by the Revenue, BC, PF, Anatel and STF may pave the way for the functioning of the social network in Brazil to be reestablished.
