Pacheco says that PEC of monocratic decisions is not retaliation for the STF

The president of the Senate, stated that the Proposed Amendment to the Constitution (PEC) that limits the monocratic decisions of ministers of the Federal Supreme Court (STF) is not a means of confronting the Court.

“It is far from being any type of revanchism, retaliation or affront to the Federal Supreme Court or the Judiciary. I would not allow myself that, I am fully aware of the importance of the Judiciary, the importance of the Federal Supreme Court, including in the consolidation of our democracy”, he told journalists after participating in the II International Sphere Forum in Rome, Italy, this Saturday ( 12).

Pacheco defended the constitutionality of a law that passes through Congress and is sanctioned by the Presidency of the Republic. For him, the participation of the entire STF is necessary.

“The strength of the Federal Supreme Court lies in its collegiality and not in its individuality”, he pointed out.

Regarding the proposed review of STF decisions by Congress, the senator commented that he considers the possibility unconstitutional.

“The final word on the constitutionality or unconstitutionality of a law in a democratic country with the rule of law rests with the Federal Supreme Court. We don’t discuss this and we don’t question it”, he concludes.

Last Wednesday (9), the Constitution and Justice Committee (CCJ) of the Chamber of Deputies. The text must now be analyzed by a special committee before going to the plenary.
