PF indicts Janones in crack investigation

The Federal Police (PF) indicted the investigation into an alleged “rachadinha” scheme in his office.

Janones was indicted for the crimes of criminal association, embezzlement and passive corruption.

The final report of the investigation was sent this Thursday (12) to the Federal Supreme Court (STF). The rapporteur is the minister.

In addition to the deputy, two of the congressman’s former advisors were also indicted.

Janones was accused of charging part of employees’ salaries to cover personal expenses. Suspicions came to light after the leak of audio recordings of the deputy’s speeches.

The term “rachadinha” is used to describe the practice of transferring part of the remuneration of an advisor or public servant to the parliamentarian or party that employs the employee.

According to the PF investigation, there was an increase in Janones’ assets to a level that would be incompatible with their income.

“In the years close to the period in which the meeting was recorded, the difference between the income and expenses of federal deputy André Janones would not be sufficient to justify the recorded increase in assets”, says the PF report.

“This fact, added to the other elements collected during the investigation, reinforces the Judiciary Police’s understanding of the practice popularly known as ‘rachadinha’ in the office of federal deputy André Janones, which, unless better judged, falls within the crime provided for in article 317 of the Penal Code (passive corruption)”.

According to investigators, the indictment is based on evidence such as statements, analysis of financial intelligence, banking and tax data.

According to the PF, Janones is the “central axis around which the entire criminal mechanism revolves”. The criminal conduct would have started “coincidentally” with the beginning of his mandate.

The decision to open an investigation into the case was taken by Fux at the beginning of December 2023, after a request from the PGR.

Deputy Attorney Ana Borges Coêlho Santos, who signed the request sent to the STF at the time, stated that it was necessary to clarify whether Janones associated himself with advisors with the aim of committing crimes against the public administration.

In one of the recordings attributed to Janones — revealed by the Metrópoles portal and confirmed by CNN — the deputy reportedly asked employees for a donation to be used in the 2020 elections. The deputy denies any irregularities.
