Poland recognized the priority of its Constitution over the laws of the European Union

On Thursday, October 7, 2021, the Constitutional Tribunal of Poland made the most important decision for the country neighboring Belarus.

He recognized the priority of the Polish Constitution over the laws of the European Union.

As the Constitutional Tribunal said, the decision was based on the fact that Warsaw’s membership in the EU does not mean that the latter’s law has supremacy in the judicial sphere.

Also, according to the resolution, this does not mean that Poland is renouncing its sovereignty in favor of the European Union.

The European Commission responded to the decision of the Constitutional Tribunal, expressing serious concern.

The European Commission stated that EU law takes precedence over national law, including constitutional norms.

They also emphasized that all decisions of the European Court are binding on every member of the European Union.

Let us recall that in March of this year, the head of the Polish government, Mateusz Morawiecki, appealed to the Constitutional Tribunal.

He asked for a ruling on whether the country’s Constitution takes precedence over EU laws.

The Prime Minister did this after Brussels criticized judicial reform in Poland, saying such changes could violate EU laws.
