Return of X: Understand what the return of the platform could be like in Brazil

Platform X requested this Thursday (26) the resumption of the social network in Brazil. It is now up to the minister, of , to analyze whether the documentation provided by the company complies with the requirements, in addition to paying the fines due.

There is no deadline for the judge to complete this analysis and decide on the return of the platform in the country.

Last week, X had already fulfilled one of the minister’s main demands by appointing lawyer Raquel de Oliveira Villa Nova as the company’s legal representative in Brazil. According to the network, it will ship to a physical office and known address.

Furthermore, the platform claims to have blocked the accounts targeted by STF requests, including that of Senator Marcos do Val (Podemos-ES). The network also stated that it had paid off the fine of R$18.3 million for failing to comply with previous Court decisions.

Another fine determined by Moraes, of an undisclosed total amount, is related to non-compliance with the order to suspend the network in the country, with a daily value of R$5 million. The punishment was applied because users were able to access X on Wednesday (18) despite the block.

On Saturday (21), Moraes requested that the Judicial Secretariat of the Court. The total amount owed by X was not disclosed.

To decide whether or not to authorize , Moraes must check:

  • whether the appointment of the company representative meets all legal requirements;
  • whether all required documentation reached the STF;
  • whether all orders to block profiles and content indicated by the Court were complied with;
  • the due payment of fines imposed for non-compliance with previous decisions, including the fine imposed last week for the punctual resumption of the network for some users after an update to X.
  • In addition to Moraes, the unblocking of the platform in the country also depends on communication from the National Telecommunications Agency (Anatel) to internet providers in the country.
