The Federal Supreme Court (STF) decided to prohibit the use of public resources or official media for acts that praise or celebrate the . The score in the virtual plenary was 8 votes to 3.

The starting point was an event organized by the Ministry of Defense, under the government of former president Jair Bolsonaro (PL), in 2020.

However, the judgment had general repercussions, that is, it applies to all other similar cases.

The discussion of the case began in the first instance, which ordered the federal government to withdraw the “Order of the Day Allusive to March 31, 1964”.

The decision, however, was reversed in the second instance. The appeal ended up reaching the Supreme Court.

The vote of the Dean of the Court, Minister Gilmar Mendes, prevailed. The minister stated that events of this type ended up accumulating in recent years, culminating in the undemocratic acts of January 8, 2023.

According to him, the event was not informative or educational in nature, but conveyed “unequivocally untrue content”, as the Brazilian State had already recognized “responsibility for several human rights violations” during the military dictatorship.

Gilmar was accompanied by ministers Cristiano Zanin, Cármen Lúcia, Flávio Dino, Alexandre de Moraes, Edson Fachin, Luiz Fux and Luís Roberto Barroso, president of the court.

Ministers Nunes Marques, Dias Toffoli and André Mendonça were defeated. For them, the judgment did not have general repercussions, as it was a “specific topic, with an effect restricted to the specific case”.
