Suspension of X will not be discussed in the STF plenary, says Barroso

The president of the Federal Supreme Court (STF), Luís Roberto Barroso, indicated, this Saturday (7), that the suspension of the social network X should not be analyzed in the Court’s plenary session after the unanimous assessment of the First Panel.

“The suspension of X has already been decided by the First Panel. The competence of the First Class is the regimental competence”, he said after the parade on September 7th, in Brasília.

Moraes’ decision confirmed

Last Monday (2), the board formed a majority to suspend the X throughout the country.

The ministers voted in favor of confirming the decision

  • Flavio Dino,
  • Cristiano Zanin,
  • Carmen Lucia,
  • and Luiz Fux.

However, Fux made a specific reservation in his vote, suggesting that the R$50,000 fine for anyone who circumvented the X blockade should not be applied indiscriminately.

The analysis of the case was called by Moraes last Sunday (1st). The minister chose to take the matter to trial in the First Panel instead of submitting it to the Court’s plenary, which has eleven ministers.

Criterion

Moraes followed the established criterion that sending it to the plenary is only necessary in criminal cases involving presidents of the Powers.

The First Panel is made up of five ministers, and its function is to deliberate on cases and legal issues that do not necessarily require the decision of the entire Court plenary.

Currently, Alexandre de Moraes is the president of the collegiate.
