TCU report points to fraud in the purchase of vests in Rio de Janeiro during intervention

The technical area of ​​the Federal Court of Auditors (TCU) requested the ineligibility of the company CTU Security LLC, responsible for the sale of 9,360 ballistic vests via the Federal Intervention Office of Rio de Janeiro, in 2018.

According to TCU technicians, there was fraud in the procedure involving the exemption from bidding, ‘characterized by the presentation of false documents to prove technical qualification, which could lead to the company being declared unsuitable under the terms of art. 46 of Law 8,443/1992’.

The total value of the contract would be R$36,709,090.99 to the public coffers. The vests would go to the Civil Police of Rio de Janeiro, but the process was suspended.

“As the business company did not present its justification reasons, the previously espoused understanding remains, regarding the characterization of fraud in the Bidding Exemption procedure, due to the presentation of false documents to prove its technical qualification, which should give rise to the company’s declaration of unsuitability under the terms”, points out the document to which CNN had access.

A company is considered unreputable when it receives a sanction for irregularities committed in administrative contracts. This punishment is the declaration of unsuitability and the company’s contracting or participation in public tenders is prevented for a certain period.

The technical opinion will be analyzed by the TCU Plenary this Wednesday (2), to confirm the understanding or not of the area that produced this report.

Target of the PF

In September last year, the Federal Police targeted this contract without bidding during the federal intervention in Rio de Janeiro, commanded by General Braga Netto.

The investigation investigates the crimes of sponsorship of improper hiring, illegal dismissal from bidding, active and passive corruption and, allegedly committed by federal public servants in the hiring of the company CTU Security LLC by the Brazilian government.

16 search and seizure warrants were executed in Rio de Janeiro, São Paulo, Minas Gerais and the Federal District. General Braga Netto, former interventionist and former minister of the Civil House, is being investigated, but was not the target of searches.

The PF stated that it found “a true criminal organization” during the investigation of the vest purchase contract and that the organization was “responsible for operating fraud in the bidding and corrupting public servants so that (the company) CTU Security LLC could successfully conclude of the amount signed in the bidding exemption process in the total amount of US$ 9,451,605.60 (9 million dollars)”.

At the time, Braga Netto declared that all the procedures of this contract were supported by the TCU and that the suspension involving the company CTU Security LLC came from the intervention office itself.
