Toffoli annuls Lava Jato convictions against Léo Pinheiro, Lula’s whistleblower

Minister Dias Toffoli, of the Federal Supreme Court (STF), annulled all decisions of Operation Lava Jato against the former president of the construction company OAS.

The minister accepted the defense’s argument that there was “procedural collusion” between the investigation task force and the Court to the detriment of the businessman’s fundamental rights.

“I grant the request contained in this petition and declare the absolute nullity of all acts carried out to the detriment of the applicant within the scope of the procedures linked to Operation Lava Jato, by the members of said operation and by former judge Sergio Moro in the performance of his activities before the Court of the 13th Federal Court of Curitiba, albeit in the pre-procedural phase”, reads the decision.

Léo Pinheiro was one of the pivots of the investigation that resulted in the conviction and imprisonment of President Luiz Inácio Lula da Silva for the Guarujá triplex case. OAS was responsible for the renovations in the apartment assigned to the PT member.

Lula was convicted of passive corruption and money laundering as a result of the investigation. However, in 2021, the PT member’s conviction was annulled by the STF, which understood that the 13th Federal Court, in Curitiba, did not have the competence to judge Lula’s cases.
